West Virginia has a Medigap birthday rule. Once a year, around your birthday, you can switch to another Medigap plan with equal or lesser benefits without answering health questions. The exact window length and rules are set by state regulators, so the details matter. Outside that window, and outside your original six-month Medigap Open Enrollment Period, standard medical underwriting usually applies.

West Virginia's rule was created by House Bill 4869 and took effect on June 11, 2026. State code gives people who have held their Medigap policy continuously for at least 24 months a window that begins on the first day of their birth month and ends 60 days later, for a policy with the same or lesser standardized benefits from the same insurer or an affiliate, with an exception when comparable plans have not been actively marketed for 12 months.
