Rhode Island's flexibility comes from a law signed on July 2, 2025. Under guidance from the Office of the Health Insurance Commissioner, anyone enrolled in a Medicare Supplement policy or Medicare Advantage plan, with no gap in coverage greater than 90 days since their initial enrollment period, receives guaranteed issue rights for any Medicare Supplement policy currently offered in the state. That window runs for the duration of the Medicare Annual Enrollment Period, October 15 to December 7, with coverage effective January 1 of the following year.
